Dunkin' Donuts' application to trademark the phrase 'Best Coffee in America' have been tentatively rejected by the US Patent and Trademark Office, according to a report.
"It is well established that a mark that consists of the generic name of a food that is the specialty of the house or a principal attraction of the restaurant has been held merely descriptive of restaurant services," the Trademark Office said in a statement, according to Drinks Business Review.
In response, Dunkin' Donuts said it is reviewing the filing. According to the Boston Globe, Dunkin' Donuts hasn't disclosed how it intends to back up the slogan. A company spokesperson told the publication that the company sells more than 1.5 billion cups of hot and iced coffee globally every year and "we are simply going through the trademark process."
