The case against the highly prominent Walt Disney Company is proving to be a difficult task to push.
An author named Isabelle Tanikumi allegedly claims that Walt Disney's biggest animated film Frozen, was copied from the book that she wrote, Yearnings of the Heart.
It seems that it is just a tad farfetched regarding the validity of the allegation since Tanikumi should be able to show that there was actual copying and that the copied work is substantially similar to the original work that is being alleged in the suit. Tanikumi is suing Disney for a whooping $250 million for allegendly violation the copyright law. Tanikumi claimed that the film had copied significant parts of her book.
The burden of proof will still lie with Tanikumi as she needs to provide sufficient and substantial evidence that her book could indeed be the basis of how Frozen's script was written and not just posted similarities.
According to Amazon, the book was published last February 7, 2013. This was 11 months before the movie Frozen was released in cinemas. However, the movie was at that time in production before the book Yearnings from the Heart was released.
Most of the reviews from people who read the book focused specifically on the lawsuit and not on the content of the book itself.
The author also cannot claim that she has sent a copy of the book to Disney. It should be read by the writers. Many writers send their creation to Disney but most of it will not be read. The people who also writes the script of the movies are also different from those reading independent authors' creations.
But should Tanikumi indeed prove that the major corporation has copied her work, Walt Disney could lose a big sum and even pay for Tanikumi's legal fees.
