A few months ago, Sofia Vergara opened up about her personal battle against ex-fiancé Nick Loeb involving two of her embryos that she had cryopreserved while they were still together.
After splitting up in May 2014, however, the frozen eggs posed a problem between the former couple - Nick Loeb wants to have the babies through a surrogate mother while Sofia Vergara wants them destroyed.
"I don't like promoting my private life," the actress said. "And I don't want to allow this person to take more advantage of my career and try to promote himself and get press for this."
The lawsuit filed by Loeb in April states that the embryos should not be destroyed under any circumstances until Sofia Vergara and Nick Loeb have reached an agreement.
"It has nothing to do with whether it's her baby or a baby," Loeb said in a separate interview, adding that he had offered the actress to waive all financial responsibilities. "Lives were already created. I wouldn't toss them aside."
"I want these children to have the best lives possible. There's nothing more that I want to do than bring these children to life," the businessman added.
However, some gossip websites now claim that on Oct. 27, Sofia Vergara and Nick Loeb's court case have been decided - the "Modern Family" actress' motion to have her ex fiance's lawsuit dismissed was thrown out by the court.
"Sofia is devastated," an insider alleged. "But Nick is committed to saving and bringing these embryos to term via surrogate."
"He's going to see this thing through until the end. Sofia's just praying that her legal team finds a way to persuade the judge that this can't go through without her blessing," the source added.
With just a month away from her wedding to Joe Mangianello, Sofia Vergara is allegedly "on the verge of a breakdown."
Meanwhile, another report by Radar Online claimed that Joe Mangianello is "flipping out" over his 400-guest wedding and is currently having a serious case of cold feet.
