James Holmes Colorado Theater Suspect Charged with 142 counts, 24 First Degree Murder

James Holmes was formally charged on Monday with 142 criminal counts, 24 of first-degree murder and 116 counts of attempted murder, in connection with the shooting rampage at a suburban movie theater showing "The Dark Knight Rises" movie.

Holmes, 24, was formally charged during his second court appearance since his arrest after the massacre during a packed showing of" The Dark Knight Rises" shortly after midnight on July 20. The massacre left 12 dead and 58 injured several in critical condition.

According to Reuters, Holmes appeared in the courtroom in the Arapahoe County Courthouse looking different than he did during his first appearance in court on July 23. His reddish-orange hair was combed forward and down, rather than the tousled look he had last week when the judge read him his rights.

Holmes sat impassively with two defense attorneys through the 45 minute hearing. He spoke only once, replying "yes" when District Court Judge William B. Sylvester asked him about a future hearing date.

During the hearing, defense attorneys asked that prosecutors turn over evidence collected in the case. They are seeking a package that news reports have said was sent by Holmes to a University of Colorado psychiatrist, Dr. Lynne Fenton.

Prosecutors responded that they had not yet opened that parcel, which according to Fox News contained a notebook outlining the shooting scenario, including stick-figure drawings.

Holmes was charged with 142 counts including two counts of first degree murder for each person who died in the movie theater shooting in Aurora. The movie house was showing the local premiere of "The Dark Knight Rises."

Unlike the first hearing, Monday's proceedings were not televised. Following the hearing, Holmes was returned to the county jail where he is being held in sequestered confinement.

Holmes, a San Diego native, was a doctoral student of neuroscience at the university's Anschutz campus before filing paperwork to drop out in June.
