US District Court Judge Lucy Koh denied Apple’s court ban towards Samsung Galaxy S3, and the Android-based smartphone will launch in the United State on schedule in the coming week.
Apple tried to keep insist its patent war against Samsung’s new smartphone, but had to backed off at the last minute after the Judge cautioned that it would force a postponement for this infringement case.
“If Apple seeks to file a motion to enjoin sales of the Samsung Galaxy S III, Apple will have to request a new hearing date from the Court,” Judge Koh wrote.
Last week, Apple requested the court to impose an injunction towards the new version of Galaxy S-series before it start to sell in the U.S. market. Apple professes that the Korean tech giant’s new device still infringed Apple’s two patents that have already at issue in Apple’s complaint on Samsung Galaxy Nexus series. The Korean company fought back and felt confidence to prove the Galaxy S3 is “innovative and distinctive.”
According to market researcher Strategy Analytics, Samsung sold 44.5 million smartphones in the first three months, more than Apple’s 35.1 million during the same period. This new Galaxy S3 has a big sell in Euro market, better than Apple’s iPhone. There is no doubt Samsung will ship a good number of Galaxy S3 in the United States too, when Apple can’t stop its coming.
